TOURNAMENT RULES & TERMS

The tournament will begin on the first of the month, and end on the last day of the month, during which time participants will be invited to provide predictions for stock or crypto performance. These predictions will include a target price, the target date of the last day of the month, and the probability that the target price will be reached. Predictions can be posted any day of the month, and points for a successful prediction will be awarded if their target price is hit at any point from the time they submit their prediction to the end of the month.

Any US stock or crypto can be used to create a prediction, as long as the target price is more than or equal to  +/- 5% from the current market price of the stock or cryptocurrency. Tournament participants can also create as many predictions within each tournament period as they would like. The end score will be an average of their score for each of these.

Scoring for the tournament will be based on the Modified Brier Score, which weighs both the success of the prediction and the accuracy of the prediction’s confidence level (the probability associated with the prediction). A Modified Brier Score will be created for each prediction individually, and the average of these within the month will be the overall score for the tournament. The scoring can range from 0 to 1, with 1 being a perfect score.

1. The online service – PredictAny Tournament (the ‘tournament’) – is offered by PredictAny (‘the Promoter’) whose trading office address is Miami, Florida.

2. If you enter into any Predictor tournament through the websites located at PredictAny.com (the Site) you agree to these Terms of Use. If you do not agree with any of these Terms of Use please do not use the Sites, because by using the Sites you will be deemed to have irrevocably agreed to these Terms of Use.

3. Please note that these Terms of Use may be revised and reissued without notice at any time by updating this posting and you agree that no liability shall attach to the Company and that you have no right to claim any compensation as a result thereof. You should visit this page regularly to review the current Terms of Use, since your continued use of the Site will be deemed as irrevocable acceptance of any revisions. Any such revisions may include extending the Terms of Use to include other terms and conditions applicable to other products or services offered by us from time to time. These Terms of Use were last updated on March 30, 2022.

4. We will assume (and by using the Sites you warrant that) you have legal capacity to enter into the agreement set out in these Terms of Use (i.e., that you are aged 18 years or over and have mental capacity and are otherwise entitled to be legally bound in contract).

5. Playing a Predictor Tournament through the web sites located at www.predictany.com (‘the tournament’).

5.1 To enter a predictor profile you must complete the registration process and accept the terms and conditions set out herein. All tournament players must be *18 years of age or older. You may be asked at any stage to provide the Company, the Promoter or a third party with a proof of age and/or identity. Failure to provide satisfactory proof of age and/or identity shall disqualify you from participation in the tournament and the winning of any prizes.

5.2 All users can play the tournament for FREE. You may only register one free profile per participant. Anybody believed to have entered more than one profile will be disqualified and will not be eligible to win prizes. The Company may use their discretion to identify registrants who have entered more than one profile under different names, email addresses and identities. The Promoters’ decision is final and neither the Company nor the Promoter will enter into any discussion about users that are disqualified.

5.3 The Company reserves the right to refuse to accept any entry which, in their opinion, does not comply with the rules and regulations of the competition or which contravenes the spirit of the tournament. The Company has an absolute discretion to disqualify any entry or vary, amend or waive the rules of the competition or terminate the tournament at any time and participants agree that no liability shall attach to the Promoter or the Company as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any participant. It is a condition of entry that all rules are accepted as final and that the competitor agrees to abide by these rules.

5.4 Only the registered user may make changes to his or her tips. Anyone found to be managing a profile that does not belong to them, on behalf of another tournament player or without their knowledge, will be removed and not eligible to win prizes.

5.5 The Company respects the intellectual property rights of others and asks users of the Sites to do the same. The Sites and all materials, characters, logos or other images, and in particular the rules and point structure incorporated by the Company, on the Sites are protected by copyrights or other intellectual property rights. No information may be reproduced in any format without prior written consent from the Company.

5.6 For the purposes of the tournament and your use of the Sites, our computer record of your entry will be considered to be your entry. We have the right to reject what, in our sole discretion, we consider to be incomplete, inaccurate or corrupted entries. The decision of the Company as to whether an entry is incomplete, inaccurate or corrupted is final.

5.7 The Company is committed to ensuring, as far as reasonably practicable to do so, that its Sites and the tournament do not cause offense to anyone using the same. We therefore request that you do not enter a name for your profile that may be considered by others to be inappropriate or offensive. A non-exhaustive list of names that may be considered to be inappropriate or offensive are names that are obscene, pornographic, racist, abusive or harassing. We reserve the right to refuse to accept, and may change any profile names which we feel, in our sole discretion, are inappropriate or offensive.

5.8 Predictions will be scored as follows:

Each prediction will be rated using the Modified Brier Score (1-Brier Score). The average of these scores for all of your predictions during the tournament period will be your overall score for the tournament. Scores are on a scale from 0 to 1, with 1 being the highest possible score.

The accuracy of a set of probabilistic predictions (also called “forecasts”) can be formally measured with a Brier score. The math is fairly intuitive. First, consider a set of events with binary outcomes (“X will or will not happen”; “Y will or will not happen”). If an event comes to pass (“X did happen”), it’s assigned a value of 1. If an event doesn’t occur (“Y didn’t happen”), it’s assigned a value of 0. Given probabilistic predictions for those events (“.92 probability of X”; “.34 probability of Y”), the Brier score is just the mean of squared differences between those predictions and their corresponding event scores (1s and 0s). That is, it’s the mean squared error:

Please note:

– Points are based on the full time result inclusive of extra time

– Penalty shootouts (if applicable) will not be considered

5.10 The Company will use the latest scores and results reported by its data provider to use as the basis of the Prediction scoring criteria.

5.11 All users will score points from the matches played after the Predictions are selected and submitted prior to the relevant Prediction deadlines. Time of Predictions submission will be recorded as per the server clock (displayed at the bottom of the screen). Profiles will not score points until their Predictions have been saved.

6. Please act responsibly when using the Sites and comply with these Terms of Use and the Rules of the tournament. It is a condition of entry that all rules and Terms of Use are accepted as final. The Company reserves the right to refuse to accept or disqualify any entry which, in its sole opinion, does not comply with the rules and regulations of the tournament or which contravenes the essence of the tournament.

6.1 Informative and explanatory information supplied by the Company relating to the tournament forms part of the Terms of Use of the tournament.

6.2 Anyone can enter or play the tournament, as long as they are of legal age and are residing within the country.

6.3 There will be multiple winners of the overall competition every month. The winners will be the users whose Predictor profiles have accumulated the best Brier Score Average throughout the duration of the competition. In the event that two or more predictor profiles in the ‘Overall’ competition have the same points, the predictor profile who has the higher number of predictions in the tournament will have the advantage. In the event that there are two or more predictor profiles with the same number of points and the same frequency of predictions, the predictor profile that registered first will be deemed the winner.

6.4 Prizes will be awarded at the end of the competition.

6.5 Prize winner(s) will be notified by email within 28 days of winning. All prizes are up to the discretion of the Promoter.

6.6 If you are a winner, you will have to respond to the notification and complete and return additional legal documents to us within 28 days of receipt. Non-compliance or notification returned as “undeliverable as addressed” will result in your disqualification as a winner and prizes will not be re-offered or deferred.

6.7 Cash alternatives are not available instead of the specific prizes. Shipping of prizes only applies to residents of the country in which the tournament is promoted in. Overseas winners are responsible for any excess costs incurred in connection with shipping prizes to them. In the event of the prize not being available, the Company will endeavour to provide a prize of a similar nature or provide a cash alternative at the Company’s sole discretion.

6.8 All winners, by accepting the prize, will agree to taking part in any publicity to do with the winning of the tournament.

6.9 By registering to play the tournament, you are accepting email updates.

6.10 The User’s email address that is held by the Company should be kept valid at all times. The Company provides a facility to allow users to update their email address at any time. If you are a winner and your contact details are incorrect, we will allow 28 days for you to correct this before deferring to the next eligible winner.

6.11 By registering to play the tournament, you are accepting email updates. The Company reserves the right to validate email addresses at any time and the right to remove, or suspend from the tournament, any profiles found to have an invalid email address.

7. Our obligations and the limits on our liability

7.1 The Company agrees to use its reasonable endeavors to maintain the Sites in a fully operating condition and error free. As the Company cannot guarantee that the Sites will always be fully operational or error free, it does not accept responsibility for any defects that may exist or for any costs or losses arising from your use of or inability to access the Sites.

7.2 Whilst the Company takes reasonable precautions to ensure that any downloads it makes available will be virus free, the Company does not warrant that any downloads will be virus free and will not cause interruptions with your computer systems.

7.3 The Company excludes, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability for any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the use of the Sites or their unavailability. This exclusion shall apply in respect of, without limitation, any interruption of services, lost profits, loss of contracts or business opportunity, loss of data, or any other consequential, incidental, special, or punitive damages arising out of the Sites, even if the Company has been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise.

8. System Abuse

If we find, or suspect, that you have: engaged in or attempted to engage in ‘spamming’ (the unsolicited emailing for business or other purposes), sent or attempted to send, created or attempted to create, or replied or attempted to reply to so-called ‘mail-bombs’ (the sending of multiple or large electronic files or messages with malicious intent or the e-mailing of copies of a single message to many users), or hacked or attempted to hack into any systems or servers run by the Company or undertaken any other activity which may adversely affect either the operation of the Sites or another person’s enjoyment of the Sites, we will immediately remove you from the system and your subscription will be cancelled. You will have no right to any refund in these circumstances and the Company reserves the right to report the matter to the relevant authorities.

9. Indemnity

You agree to indemnity and keep indemnified the Company and its officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability (whether criminal or civil) suffered and fees and costs incurred, including reasonable legal fees, resulting from any act neglect or default or breach by you or any person who may be authorized by you or for whom you are responsible (for example as employer) of any of these Terms of Use and/or from your placement or transmission of any content onto the Company’s servers, and/or from any and all use of your account.

10. Jurisdiction

10.1 The purpose of the Sites is to provide entertainment and to promote the Company’s other available services. The Sites are controlled and operated by the Company from its offices within the United States of America.

10.2 These Terms of Use shall be governed by and construed in accordance with American Law.

10.3 If any dispute or difference arises out of, or in connection with, these Terms of Use, the parties shall, with the assistance of the correct legal body, seek to resolve the dispute or difference amicably by using an alternative dispute resolution (ADR) procedure acceptable to both parties before pursuing any other remedies available to them.

10.4 If any dispute or difference is not settled by means of ADR, you irrevocably submit to the exclusive jurisdiction of the Florida courts.

10.5 If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein.

11. The Company cannot accept any liability if matches the tournament is based on are abandoned, canceled or postponed due to reasons outside our control. Where matches are rearranged, points will be allocated to profiles as per the date when the match is actually played.
